    To everyone’s surprise, Special Counsel Jack Smith has sought to dismiss two high-profile cases against former president Donald Trump. This comes as Trump gets set to become the president of the United States in January as the president elect. The move complies with the Justice Department’s current policy that establishes that a sitting president cannot be charged. Smith who was sworn in 2022 by U.S Attorney General Merrick Garland first indicted Trump on serious offenses. These were allegations of seeking to compromise the conduct of the U.S elections and the security of the country. However, the decision to withdraw these cases represents a significant shift in approach, especially given Trump’s controversial legal history.

    Trump replied on his Truth Social site, celebrating the decision. He described the cases as “empty and lawless,” saying they should not have been initiated in the beginning.

    Here’s a breakdown of the cases against Trump and their current status

    January 6 Election Interference Case

    This, once seen as one of the most dangerous legal dangers to Trump has now been dropped. U.S. District Judge Tanya Chutkan signed on the heads of agreement for the dismissal. The ‘crimel’ of the year involved former President Donald Trump and his efforts to overturn the result of the presidential elections in 2020 that he lost to Joe Biden, the attack on the Capitol building on January 6, 2021.The indictment mentioned at the beginning that Trump engaged in conduct that threatened democracy, But in July a Supreme Court decision provided former presidents with the blanket protection from prosecution. The case was then remanded back to the trial court where new evidence was being adduced.Despite the new evidence that Smith’s team had come with in October the unprecedented legal and political consequences of prosecuting a president elect led to dismissal of the case.

    Classified Documents Case

    The classified documents case also involved removal of Trump. This case accused Trump of illegally keeping classified records from his presidency at his Mar-a-Lago estate in Florida after leaving office. He was also accused of impeding federal attempts at recovering those documents.Trial Judge Aileen Cannon dismissed the case in July after a series of hearings. Trump had pleaded not guilty and denied any wrongdoing.

    Hush Money Case

    This case involved around hush money payment made to adult film actress Stormy Daniels that made Trump be convicted of 34 felony charges of making a false business records. It was the first time that a former US president had been convicted of a crime. Judge Juan Merchan put the sentencing on hold, indefinitely. Trump’s legal team is only seeking to have the conviction overturned. Arguing that it could disrupt his transition to the presidency. The prosecutors have been invited to file their response to defense motion by December 9. Manhattan, District Attorney Alvin Bragg, who initiated the case said that the end must meet the needs of presidential duties concurrently with the role of the jury in the process.

    Georgia Election Trial

      In Georgia Trump was accused along with 18 others of plotting how to change the results of the 2020 presidential election. However, that case has reached a standstill. An appeals court is considering whether Fulton County District Attorney Fani Willis should be disqualified from the case because she had a romantic interest in the special prosecutor.While four defendants have pleaded guilty, Trump and the others maintain their innocence. Pretrial motions are set for December 5, But any trial isn’t likely while Trump stays in power.

      The dropping of these cases highlights the legal and political complexities of prosecuting a president-elect. While Trump has faced numerous allegations, his upcoming presidency raises questions about how the justice system can navigate such high-profile cases while balancing constitutional and political considerations.
